1. Acceptance of Terms
By accessing or using Murasaki (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is operated by Murasaki Italia K.K. (茈イタリア株式会社), a company organized under the laws of Japan.
2. Description of Service
Murasaki is an AI-powered learning and accessibility tool that processes publicly available YouTube and Instagram content to enable question-and-answer interactions. The Service provides AI-generated responses based on creator content and should not be considered professional advice.
The Service is designed to make knowledge contained in long-form video content accessible to users who may not be able to consume it in its original format — including users who are deaf or hard of hearing, users with cognitive or attention-related disabilities, non-native speakers, and anyone who benefits from an alternative way to access publicly available educational content.
3. How the Service Processes Content
When you add a YouTube channel or Instagram profile to the Service, the following occurs:
- The Service retrieves publicly available video metadata (titles, descriptions, publish dates) and text transcripts of publicly available videos
- Transcripts are indexed and processed to enable AI-powered question-and-answer functionality
- AI-generated responses cite specific source videos so users can find and watch the original content
The Service does not:
- Host, redistribute, or display the original video or audio content
- Access private, unlisted, or paywalled content
- Bypass any authentication, login, or access controls
- Sell or license creator content to third parties
- Replace or substitute the original viewing experience — the Service is designed to complement and drive users back to the original content
4. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service
- Use automated tools to excessively access the Service beyond normal usage
- Redistribute, republish, or resell AI-generated content as if it were original creator content
- Use the Service to create competing content databases or bulk data exports of creator transcripts
- Misrepresent AI-generated responses as direct quotes or official statements from content creators
6. Billing and Subscriptions
Paid plans are billed monthly or annually through Stripe. All paid plans include a 7-day free trial with a credit card required.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before price changes take effect.
7. Content, Intellectual Property, and Legal Basis
All content analyzed by the Service (YouTube videos, Instagram reels) remains the intellectual property of its original creators. Murasaki does not claim ownership of any third-party content.
The Service is operated under Japanese law. The processing of publicly available content is authorized under the following provisions of the Japanese Copyright Act (著作権法):
Japanese Copyright Act, Article 30-4 (Non-Enjoyment Purpose Use):
Article 30-4 of the Japanese Copyright Act (著作権法第30条の4) permits the use of copyrighted works where the purpose is not to personally enjoy, or cause another person to enjoy, the thoughts or sentiments expressed in the work (思想又は感情の享受を目的としない利用). This includes:
- Data analysis (第2号): Extraction, comparison, classification, and statistical analysis of language data from copyrighted works
- Computer data processing (第3号): Processing in which the creative expression is not perceived by human senses, such as creating vector embeddings and search indices
The Service processes text transcripts through computational analysis (chunking, embedding, indexing) to enable AI-powered question-and-answer functionality. Users interact with AI-generated responses — not the original creative expression. This constitutes non-enjoyment purpose use under Article 30-4.
Japanese Copyright Act, Article 47-5 (Minor Exploitation for Information Analysis Services):
Article 47-5 (著作権法第47条の5) independently permits the display of minor excerpts from copyrighted works as part of an information analysis service. When the Service provides AI-generated answers that reference or cite small portions of transcript content, this constitutes minor exploitation (軽微利用) for the purpose of furnishing the results of computerized data analysis, as authorized under Article 47-5, paragraph 1, item (ii). The Service does not display full transcripts to end users — only synthesized answers with brief citations directing users back to the original source material.
Supplementary: U.S. Copyright Law (Fair Use):
For users in the United States, the Service's processing of publicly available content additionally qualifies as transformative fair use under Section 107 of the U.S. Copyright Act, consistent with Authors Guild v. Google, Inc. (2d Cir. 2015). The Service creates a fundamentally different product (an interactive, searchable knowledge base) from the original works (linear video content), does not substitute for the original viewing experience, and is designed to complement and drive users back to the original content.
Accessibility purpose: The Service additionally serves as an accessibility tool, making knowledge contained in audio and video formats available to individuals who face barriers to consuming content in its original form, including but not limited to individuals who are deaf or hard of hearing, individuals with cognitive or learning disabilities, and non-native language speakers.
AI-generated responses are provided for personal learning purposes only, may contain inaccuracies, and should not be treated as direct quotes from content creators. You should verify important information independently and watch the cited source videos for full context.
8. Creator Content Requests and Copyright Compliance
We respect the intellectual property rights of content creators. While the Service's use of publicly available content is authorized under Japanese law (see Section 7), we maintain a voluntary content removal process as a matter of good faith and respect for creators.

If you are a content creator and would prefer that your publicly available content not be processed by the Service, you may submit a removal request to:

- Proof that you are the owner of the channel or profile (e.g., a message sent from the channel's associated email address or a screenshot of your creator dashboard)
We will review all good-faith removal requests and respond within 14 business days.
DMCA Compliance (United States):
For creators subject to U.S. law, we additionally comply with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been used in a way that constitutes copyright infringement under U.S. law, you may submit a DMCA takedown notice to the email address above. Your DMCA notice must include:
- Identification of the copyrighted work you claim has been infringed
- Identification of the material on the Service that you claim is infringing, with enough detail for us to locate it
- Your contact information (name, address, phone number, and email)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Your physical or electronic signature
Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the identified material and notify the affected user. We may also terminate the accounts of repeat infringers.
9. Limitation of Liability
The Service is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Murasaki, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your data will be deleted within 30 days.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) as the court of first instance.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
